1. Acceptance of Terms

By accessing or using Evidexi's website (evidexi.com), application, tools, guides, playbooks, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

These Terms form a binding legal agreement between you and Evidexi ("we," "us," "our"). You represent that you are at least 18 years old and legally able to enter into this agreement.

2. Not Legal Advice; Not a Law Firm

Evidexi is not a law firm. We do not provide legal advice, legal opinions, legal representation, or any other legal services. Nothing on this website, in our application, in any guide, blog post, tool output, email, playbook, or other communication constitutes legal advice.

No attorney-client relationship is created by your use of the Services. Your use of the Services does not establish any attorney-client relationship, confidentiality obligation, or fiduciary duty between you and Evidexi or anyone associated with Evidexi.

Our content and tools are provided for general educational and organizational purposes only. Laws, court rules, filing requirements, and procedures vary significantly by state, county, judge, and case type. You are solely responsible for verifying any information relevant to your specific situation.

3. Use of Our Services

You may use the Services for personal, non-commercial purposes related to your own family court documentation. You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law
  • Resell, reproduce, republish, or redistribute any portion of the Services without our written permission
  • Scrape, crawl, or use automated systems to access the Services beyond reasonable use
  • Reverse engineer, decompile, or attempt to derive source code from the Services
  • Attempt to gain unauthorized access to our systems, accounts, or data
  • Use the Services to harass, defame, or harm any person
  • Upload or transmit malware, spam, or unlawful content through the Services
  • Impersonate any person or entity

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason.

4. Accuracy of Information

5. User Accounts and Content

You retain ownership of any content you submit to the Services ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, use, display, reproduce, modify, and distribute your User Content solely for the purpose of operating and improving the Services.

You are solely responsible for your User Content. You represent that you have all necessary rights to your User Content and that it does not violate any law or third-party right.

6. Intellectual Property

All content on the Services (other than User Content) including text, graphics, logos, images, software, guides, playbooks, and tools, is owned by Evidexi or its licensors and is protected by copyright, trademark, and other intellectual property laws. You receive no ownership rights by using the Services.

7. Third-Party Content and Links

The Services may contain links to or information from third parties. We do not endorse, control, or take responsibility for any third-party content, services, or websites. Your use of third-party content is at your own risk.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED USE.

WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, THAT RESULTS WILL BE ACCURATE OR RELIABLE, THAT THE SERVICES WILL BE AVAILABLE AT ANY PARTICULAR TIME, OR THAT ANY ERRORS WILL BE CORRECTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVIDEXI AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or goodwill
  • Outcomes in any legal proceeding, custody decision, or court ruling
  • Any action you took or failed to take based on information in the Services
  • Service interruptions, data loss, or security breaches
  • Any damages arising from third-party content or conduct

OUR TOTAL AGGREGATE LIABILITY TO YOU, FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES, IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Evidexi and its owners, officers, employees, contractors, agents, and affiliates from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Services
  • Your User Content
  • Your violation of these Terms
  • Your violation of any applicable law or third-party right
  • Any action taken or outcome in any legal proceeding involving you

11. Mandatory Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services ("Dispute") shall be resolved exclusively through individual binding arbitration, not in court. Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. The arbitration shall take place in Delaware, USA, or virtually at the arbitrator's discretion.

You waive any right to bring claims on a class, collective, or representative basis. You and Evidexi each agree that any Dispute shall be brought only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative action.

You may opt out of this arbitration provision within 30 days of first accepting these Terms by emailing [email protected] with "Arbitration Opt-Out" in the subject line. Small claims court is available for qualifying claims.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. Any Dispute not subject to arbitration shall be filed exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

13. Copyright Infringement (DMCA)

If you believe content on the Services infringes your copyright, send a notice that complies with the Digital Millennium Copyright Act to [email protected]. We will respond in accordance with applicable law.

14. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

15. Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top of this page reflects the most recent change. Material changes will be communicated through the Services or by email where appropriate. Continued use after changes become effective means you accept the updated Terms.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Evidexi regarding the Services and supersede any prior agreements.
